Abound Electronics Ltd t/a AVITHA Standard Warranty
Abound Electronics Ltd trading as AVITHA, registered at 6th Floor AMP House, Dingwall Road, Croydon, CR0 2LX, United Kingdom with Company Registration Number 07570357, presents our Standard Warranty for the Solutions we provide. Throughout this document, “AVITHA”, “we”, “us”, and “our” refer to both our dedicated in-house teams and our Affiliates.
Definitions:
• Standard Warranty: Represents the warranty services and conditions detailed herein.
• Provision: Refers to items, including but not limited to hardware, software, or SaaP (Service as a Product) that AVITHA obtains from third-party manufacturers or suppliers and offers to our customers.
• Hardware: Any physical item procured from AVITHA.
• Accessories: Complementary physical components that accompany a hardware item, such as connectors, cables, and remote controls.
• Software: Comprises operational software and firmware associated with or intrinsic to a hardware item or by stand-alone.
• Service: Constitutes any work, including installation, design, consultation, audit, programming, commissioning, support, and maintenance, performed by AVITHA.
• Solutions: Represents the collective offerings, both Provisions and Services, made available by AVITHA.
• Affiliates: AVITHA’s authorised entities or professionals that, in coordination with our principles and protocols, offer, install, or service our Solutions. While they align with our standards, Affiliates maintain their independent operations.
Warranty Coverage:
1. Provisions Warranty: AVITHA assures that if any Provisions within our Solutions demonstrate defects in materials or craftsmanship during typical usage, we will match the original manufacturer’s or supplier’s warranty terms. However, the AVITHA warranty duration will never exceed 2 years, irrespective of the manufacturer’s or supplier’s provisions.
2. Services Warranty: A standard warranty period of 2 years from the service initiation date is provided by AVITHA.
3. Transferability: This warranty is exclusive to the original Solution purchaser and cannot be transferred.
4. Territorial Scope: Warranty is valid solely for Solutions delivered or executed within the UK boundaries.
5. Replacement and Repair: AVITHA may offer new, refurbished, reconditioned, or alternate brand replacements for Provisions. The warranty for replaced or mended Provisions is restricted to the remaining original warranty duration.
6. Software: Software adherence is governed by the primary manufacturer’s Software End-User License Agreement. This warranty excludes software updates, automatic software augmentations, and related problems unless AVITHA directly implements them.
7. Limitations: AVITHA’s commitments under this warranty revolve around repair, replacement, or issuing credit for defective Solutions. We aren’t accountable for indirect or direct damages arising from Solution use or misuse.
Exclusions. This Standard Warranty does not cover:
• Batteries, lamps, and other consumables.
• Damage due to misuse, abuse, accidents, or non-compliance with installation and maintenance instructions.
• Solutions modified or altered.
• Normal wear and tear.
• Any Solutions not purchased from AVITHA.
• Provisions with altered, defaced, or removed serial numbers.
• Labour costs to diagnose, remove, repair, reinstall, or reprogram any hardware, software, or SaaP.
• Maintenance, service, or configuration modifications performed by anyone other than AVITHA, including tampering with hardware, software, or configuration settings.
• Solutions that haven’t been serviced by AVITHA on an annual basis. This does not apply to solutions that are intrinsically not maintainable, such as but not excluding wiring schematics, drawings, audit and consultancy reports, etc. In cases where AVITHA’s warranty is voided, clients may still find that certain Solutions carry a valid warranty with the original manufacturer or supplier. In such scenarios, clients will be required to liaise directly with those entities for any claims. AVITHA will not be involved or assume responsibility in these external warranty processes.
Warranty Claim Process:
1. Notification: Notify AVITHA’s warranty service within the warranty period, providing a description of the defect, the Solution’s reference, serial and model numbers, current operating system version (if applicable), and the original proof of purchase or service commencement.
2. Claim Queue: Upon receipt of a warranty claim, AVITHA places the claim in the claim queue. Claims are typically attended to in the order they are received. However, claims associated with our support and maintenance contracts are prioritized and attended to immediately as per the stipulations of the respective contract. While AVITHA strives to resolve general warranty claims as swiftly as possible, we cannot guarantee a maximum resolution time. For those under a support and maintenance contract, resolution guidelines will adhere to the specifics of their individual agreements.
3. Data Privacy: Before returning any hardware or software, customers are advised to back up any data stored on the hardware or software. AVITHA is not responsible for any loss of data stored on the hardware or software during the repair or replacement process.
4. Shipping Costs: Customers bear the shipping costs for warranty evaluations and repairs.
Termination of Warranty. The warranty is voided if:
• The Provision has reached its End-of-Support (EoS) as determined by the original manufacturer. Note that a Provision may reach its End-of-Life (EoL) status but may still be supported by the manufacturer, in which case the warranty remains valid.
• The customer is in breach of the terms and conditions of this warranty.
Legal Rights: This warranty imparts specific rights, and you may have supplementary rights depending on the jurisdiction. This Standard Warranty does not diminish such rights.
Governing Law: The laws of England and Wales, disregarding any conflicts of law principles, govern this Standard Warranty.
Limitation of Liability: AVITHA’s liability under this warranty is strictly limited to the corrective measures defined for each type of Solution. AVITHA disclaims responsibility for any secondary or consequential damage or harm arising from the use or non-use of the Solution.
Extended Warranties: These are available exclusively at the inception of the Solution purchase or if explicitly articulated.
Final Terms: This document represents the full extent of AVITHA’s warranty responsibilities concerning the Solutions, superseding prior written or verbal communications on this subject.
